MORTGAGE FORECLOSURE SALE: Default having been made in the payment of the indebtedness secured by that certain Mortgage executed by ANDRE HENDERSON and MELINDA COOK, husband and wife, (herein referred to collectively as “Borrower”), to WILLIE KILCREASE and BRENDA SMITH FINLEY (herein referred to collectively as “Lender”), dated June 15, 2016, said Mortgage being recorded in the Office of the Judge of Probate, Coffee County, Alabama, in Book 735, Page 425, and Lender, by reason of such default having declared all of the indebtedness secured by said Mortgage due and payable and by virtue of the power of sale contained in said Mortgage will sell at public outcry for cash to the highest bidder, in front of the main entrance of the Coffee County Courthouse, Elba, Alabama, during the legal hours of sale on October 24, 2017, the following described real estate: One lot or parcel of land in Coffee County, Alabama as surveyed by Kinsaul & Associates as per plat dated March 22, 1999, and being more particularly described as follows: Commencing at a 5/8" iron pipe found marking the locally accepted Northwest corner of the NE¼ of the NE¼ of Section 21, Township 4 North, Range 21 East; thence S01°44'56"W along a fence for a distance of 250.00 feet to an iron pin found (½" rebar); thence S88°31'20"E for a distance of 801.00 feet to an iron pin found; thence N01°44'56"E for a distance of 40.00 feet to an iron pin found; thence S88°31'19"E for a distance of 480.12 feet to an iron pin found on the West Right of Way (R/W) line of Coffee County Road #617 (80' R/W); thence along said R/W line S01°33'48"W for a distance of 316.45 feet to an iron pin found and the POINT OF BEGINNING; thence continuing along said R/W line S01°33'48"W for a distance of 36.00 feet to an iron pin set (½” rebar cap #19258); thence along a curve to the left having a radius of 5769.58 feet to an arc length of 64.45 feet with a chord bearing and distance of S01°14'23"W, 64.45 feet to a concrete monument set (#19258); thence leaving said R/W line N88°15'04"W for a distance of 177.69 feet to a concrete monument set; thence N01°44'56"E for a distance of 100.44 feet to an iron pin set; thence S88°15'04"E for a distance of 177.00 feet to the POINT OF BEGINNING.  Said land is located in the above mentioned forty and contains 0.409 of an acre more or less.  Property Address: 3927 County Road 617, New Brockton, Alabama, 36351.  Together with one 1998 Redman mobile home (28 x 76 feet.)  This sale is made for the purpose of paying the indebtedness secured by the above-described Mortgage, and the proceeds thereof will be applied as provided by the terms of said Mortgage.
